Custody Situation:

 

 

Prior to Deployment

 - Sailym and Sage have different fathers

 - Divorce papers granted mother custody

 - Father had standard visitation every other weekend

 - Jones has been primary custodial parent for 10+ years

 

Deployment

  - Sage lived with her biological father during deployment

 

Post Deployment

 - Upon mother's return from Iraq, she was never returned to her mother

 - Mother currently gets Sage ever other weekend

 - Mother requested a trial in November 2008

 - Trial is set for 0900 20Aug09 @Wilkes Barre courthouse annex building

 

Custody Hearing 20Aug09

 - The judge told the lawyers to settle out of court based on the his belief that the PA Statute that protects deployed soldiers could be unconstitutional and therfore he wouldn't be applying this mandate to this case

 - The judge stated that this custody issue had nothing to do her deployment

 - The judge threatened, on the record, to limit parenting time if he found out the media was reporting on this case; in his view - using the child
