My dad was over serving our Country in Iraq. Now I only can see him every other weekend because my mom is taking advantage of a loop-hole in the law that makes my dad loose points in the eyes of the FOC. My dad gave temporary custody to my mom while he was in Iraq because mom said it's "what she needed" to be able to take care me while daddy was gone. When daddy came home and was ready to return to the 50/50 we've had for the past 5+ years, mom said no.

This website gives people an insight as to certain facts of the case and also lets people get to know Joey and his Daddy a little bit better. There are claims that this website is "unprofessional" and "disrespectful to the military." From what we know, some of these comments have come from Steve Erb, the mother's most current husband, and the mother herself. He's also gone out of his way to complain to elected officials for "dragging Joey into the media frenzy" and "putting Joey through hell." UNBELIEVABLE. Steve has dropped off smear packets, in person, to my legislators and continues to complain about what everyone else is "doing to Joey." He fails to understand that THEY are the ones that refuse to give me anymore time than they have to with MY SON. Listen to Holly deny me of time with Joey. Steve and Holly Erb of Mason, Michigan continue to hinder my relationship with my son. Also, Joey's soon-to-be-ex-stepmother, Angie Babbitt-McNeilly of Grand Ledge, has referred to me as "satan." Now, Joey has asked the question -- "Is my dad going to hell now because she calls him satan?" She also squandered $38,000 from my bank account while I was off serving our country. She would spend $22-$55 on just lunch alone. (links to receipts will soon follow) How's that for a person with morals?

Ingham County Friend of the Court Director Don Reisig has lied when he stated that the "court's recommendation issued in May not to restore shared custody has nothing to do with McNeilly's military service." He went on to say that "confidentiality laws bar him from saying much about the case."

POINT 1: It's a fact that I lost points in multiple categories due to my Support of Operation Iraqi Freedom.

POINT 2: So, due to confidentiality, he can't talk about the case but he can state on the record that the military had nothing to do with it? I thought it was confidential information. It must be more political correctness at it's finest.

 

I've since learned that Mr.Louie Belzer has wronged many other people. He is the disgusting individual that showed his bias in the last FOC recommendation. His actual recommendation will soon be posted on this site for you to see for yourself. And he calls himself a marine?

 

Mr. Louie Belzer and Mr. Don Reisig -- YOU WILL NOW ANSWER FOR YOUR ACTIONS AND BE HELD ACCOUNTABLE. Information on supporting the FOC REFORM will soon follow.


 

It's interesting to listen to the claims of the FOC. Claims that they are "for the children" and the "best interests of the children." Does anyone really believe that anymore? Not even our Congressmen and Senators believe that. Look at the comments they have made while in the House Family & Children Services Committee:

 

 

 

 

 

 

Representative Jacob Hoogendyk  R-Kalamazoo

[directed at Ken Weichman of the State Bar Association]  "It’s my suspicion in the case that was brought before us, that this individual serving in the military, I would tend to doubt that it was the courts individual analysis or decision that his military service should be counted against him because he abandoned his child. But rather I would suspect that this was more the case of a slick lawyer telling the mother of this child, 'Here is how we can get this child away from the father, we’ll just use the argument that he abandoned his child.' Nevertheless, it’s because he went into military service. I think that some of the arguments you use, shows how misguided this state and the FOC is.

I also think that, in providing an example to a child of what a good father is, a tremendous example to that child is what that parent is willing to do for his or her family and his or her family and country. I think that anyone who is willing to put his life on the line for his country and his family. To provide and to vouch safety the freedoms that his family has and his Country, is an example to that child that he can look up to and can admire and appreciate about that parent. That child is not going to say my daddy left me. But that child is going say that my daddy was willing to put his life on the line for my family, for me, and for my country. And that should strengthen the bond between the child and the parent - not diminish it."

[directed at Ken Weichman of the State Bar Association]  "We are Representatives. We are not the court. There was a poll taken that showed 87% of the people polled were in favor of this legislation. We're the voice of The People, each of the Representatives that look at policy and make significant changes, if necessary. I'm saying, that you're speaking to the Legislature that enacts and makes the laws that the courts are to observe. It's of The People, By The People, and For The People and that's why we're here.

So we're considering all this and I've had a lot of people call my office concerning this, a lot of concerned people. There is something that needs to be fixed. We speak of Justice in the court systems. I hope we don't always speak of fairness. What's fair can change between my eyes, your eyes, and the next person's eyes. We're looking at what is Just and that which is Right. We're setting guidelines for policy that needs to be corrected for boundaries that need to be set."

[directed to SPC McNeilly after House Testimony]  "Do you feel that your child was kidnapped of you from your custody rights? The mental anguish that you probably had overseas. A lot is going through your mind in what you're going to have to face and it's just unreal that our point system. I think that we should have a point system that's giving, whatever it is, 5, 10, 15, 20, or 50 bonus points when we deploy overseas to Serve.

This is our fault. We can't push and point the blame. As you've made a sacrifice over in Iraq, you're making a sacrifice for others to get good legislation through. And we're really thankful that you've come forward today."

Representative Barb Vander Veen  R-Ottawa

[directed at Ken Weichman of the State Bar Association]  "It’s been clearly established that it’s in the best interest of their child to have both parents in their life. Children are far more resilient than they are given credit for.  Sociopaths can and are very often are a lack of a father or mother figure in their life. And yet you still can find the need to take these children away from one parent or the other."

Representative Fulton Sheen  R-Allegan

[directed at Ken Weichman of the State Bar Association]   "The parental bond is the most important bond that exists. You’re saying it’s fair to a child and a parent to remove that parent while the parent is serving their Country. Without the right of representation. Without the right of their day in court. With no regard to their parental rights whatsoever. I cannot understand how you can even think that. I cannot understand why everybody, constantly, takes the whole idea of child custody and child protection services and puts it into another category. Which no other court of law would ever recognize the things that you’re saying here. We’re going to prevent you from taking their children from them while they are in Iraq. You should not be allowed to take a child away from a parent that is serving this nation. You should not be allowed to disallow them to their day in court.
